THE ARPAIO PARDON: IMPUNITY FOR LAWMEN MORE THAN FOR RUSSIAGATERS?
Rolling Stone's Brigitte Dunlap writes:By pardoning someone with [Sheriff Joe] Arpaio's history of illegally targeting racial minorities, [President] Trump endorsed the use of policing practices to deprive people of color of their rights under the Constitution. Furthermore, by pardoning Arpaio for the specific crime of defying a court order, Trump announced his intention to free his cronies from accountability for lawbreaking, raising the possibility that he will discourage his campaign associates from providing evidence in the Russia investigation with the promise of pardons if they are held in contempt of Congress or the courts.I've seen variations of Dunlap's second argument made repeatedly since last week: Trump pardoned Arpaio, so it's obvious he'll give cover to everyone involved in Russiagate. I think that's quite possible -- but it's not inevitable. On Russiagate, Trump will do what he thinks is best for Trump. It's clear that he's been thinking about pardons for Russiagate participants, possibly including himself, but I think he would have been considering Russia pardons even if he'd been talked out of pardoning Arpaio.
On the other hand, if the Russia investigation seems likely to bring down a couple of current or former underlings while leaving Trump and his family (or maybe just Trump) unscathed, I think he'll let the convicted parties suffer their punishment without lifting a finger to help them. He doesn't care -- he expects loyalty from others, but if he isn't personally at risk, he won't return that loyalty. If he thinks nothing can be traced back to him, he'll probably let underlings dangle.
Dunlap's first point is more important. With the Arpaio pardon, Trump made it clear that people in law enforcement can do anything to non-white people and he'll back them up. That's just who Trump is -- a product of the white-backlash era that gave us Rudy Giuliani. We've known this about Trump at least since he demanded the death penalty for the Central Park Five.
So although such convictions are rare, I'm predicting that Trump will pardon literally every police officer found guilty of brutality during his term. I say this with one qualification: If a cop is found guilty of brutality toward a True Patriot of some kind -- a militia member, a Bundy family member or Bundy wannabe -- Trump won't issue a pardon. Anyone else? A Darren Wilson, a Daniel Pantaleo, a pseudo-cop like George Zimmerman who's somehow found guilty, against the odds? A Trump pardon is a certainty.
That's almost worse than Trump pardoning Paul Manafort or Michael Flynn.
