Maybe a flaw that is "fatal to [the law's] ultimate implementation" is that the state will never enforce it because then it would need to defend the law in court, and it can't. Passing the law is for show, and the law makes a show of requiring that corporations do something for show. And the corporations will probably put on the show, and that's how it's intended to work.
